Privacy Policy

Brightest Day Labs (“we”, “us” or the “Company”) is committed to protecting your privacy. This Privacy Policy ( the “Policy”) explains how we and our affiliates, officers, agents, partners and employees collect, use, and maintain the personal information of our customers and users (“you”) who download our mobile application, Panther’s Gameday (the “App”), and create an account with us. This Policy also sets forth the choices and the rights you have regarding our use of your information with respect to your use of the App.
By accessing or using the App, you agree to abide by the terms of this Policy, and to our collection, use, and maintenance of your personal information in accordance with this Policy. If you do not agree to this Policy, you should refrain from using this App or otherwise provide us with your personal information.
Information We Collect and Track
We may collect information (i) from you on this App; (ii) from integrated platforms and other websites and (iii) in email, text, and other electronic messages or other communications between you and us. In doing so, there are two types of information we may collect about you:
(i) Personal information which you provide when creating an account and interacting on the App, or at certain other points (such as via forms or emails), for example if you sign up for email lists, or leave a comment on our App. Such information may include your first name, last name, email address, or other elements of personal information voluntarily submitted or necessary to process your request, including, among others, age, gender and telephone number. If you contact us, we may keep a record of your correspondence, including any information contained therein.
(ii) Tracking data, which is automatically collected from you each time you visit or interact on the App. Such data may include, among others, device push notification token, device platforms (e.g. Android or IOS), geolocation data and your activities while on the App, and does not include cookies and other tracking technologies. We attempt to aggregate such tracking data so that it is not tied to any of your personal information; however, due to the nature of the internet, this is not always feasible and some tracking data may be traceable back to you or one of your devices.
How We Use Your Information
We use the information we collect from you, including any personal information, for our organizational purposes, to perform the services offered to you and improve our App, including, among others, for the purposes of facilitating account creation and user authentication, drafting and sending transactional emails, advertising and marketing our services and our partners’ services, tracking game participation, understanding and analyzing user behavior and engagement.
We also use the aggregated tracking data we collect for a variety of purposes, including, for example, to track user engagement with our App.
How We Share Your Information
We will not disclose any of your personal information to third parties, except (i) to Sunrise Sports & Entertainment, LLC, an agent of the Florida Panthers Hockey Club and its subsidiaries, affiliates, and parent companies, other of our affiliates, officers, agents, partners and employees, consultants and sub-contractors in connection with the operations of our Company; (ii) to certain established third-party vendors, including partners that perform services for us in connection with the operation of our App (for example, third-party vendors who assist us in performing security and penetration testing); (iii) our marketing and advertising partners, including game sponsors; (iv) when we believe that such disclosure is required by law; (v) to enforce or apply this Policy; (vi) when we believe such disclosure is necessary or appropriate to protect our rights, property, security or safety, or that of the public; (vii) as otherwise stated in this Policy; or (viii) otherwise at your request or with your express permission.
When we share information with these third parties, we seek to limit such sharing to what is required, and to ensure that such third parties will use the information solely for the purpose of providing services to us and in accordance with this Policy.
Some privacy laws define the terms “sell”, “sale” and “sharing” broadly to include the sharing of personal information with third parties for something of value, even if no money is exchanged. In some cases, for example to offer free games within the App, we do share your personal information with Sunrise Sports & Entertainment, LLC to allow game sponsors or advertising vendors to use your personal information for certain purposes in addition to providing and improving the services within our App, including cross-context behavioral or targeted advertising. This is considered a “sale” or “sharing” under applicable privacy law. Participation in the games is purely voluntary, and you may at any time opt out of the sale or sharing of your information as described below (Your Rights and Updating Your Preferences).
To the extent made available, we may sell or share the following categories of personal information to third parties:
· Identifiers: first name, last name, email address, phone number, zip code, date of birth;
· Characteristics of protected classifications under California or federal law: gender.
We retain the right to transfer, sell, assign or change the ownership of all information pursuant to a merger, consolidation or other transaction relating to the Company or our assets.
How Long Your Information Is Stored
We will retain your information as necessary to provide and develop our services to you in connection with the App. We will also retain and use your information for as long as needed to comply with our legal obligations, resolve disputes and enforce any agreements. We may also retain information that has been deidentified and that no longer identifies you indefinitely.
How Your Information Is Protected
We strive to protect all information we collect, use, and maintain from loss, misuse or alteration. We maintain reasonable safeguards to ensure the safety and security of your information, which include, among others, that all the information collected is encrypted at rest and in transit, that all data access to your information is restricted by the identity and role of each and every processor, and that all system access to your information is secured with tokens and user role permissions, among the Company and its affiliates, officers, agents, partners and employees. We also ensure that third-party security vendors will perform security and penetration testing.
We strive to protect your information to the best of our ability, while you should recognize that there is no “perfect security” on the internet. Because internet communication is unsecure, it is possible that the information you supply to us via this App will be intercepted during transmission.
Other Communications
From time to time, we may e-mail you with information regarding important developments affecting the Company. We may also e-mail you on occasion regarding the App. Such e-mails may be sent to you even if you have not requested to receive any communication from us. You may otherwise opt out of marketing and other non-transactional email communications by contacting us at the email address below, or by clicking the “unsubscribe” link in the email.
Links to Third-Party Websites
The App may contain links to websites and platforms owned and operated by third parties, including, among others, third-party links to view team schedule, purchase tickets, parking, concession and merchandise. We are not responsible for and have no control over the privacy policies of those sites. We encourage you to review the privacy policies of those third parties prior to providing them with any of your information.
Your Rights and Updating Your Preferences
Under certain circumstances, and subject to legal conditions, you may have the right to object to the processing of your personal information, to request a copy of the personal information about you which we hold, to request correction, to opt out of sale, sharing and/or targeted advertising and marketing, and to withdraw prior consent to the processing of your personal information, or request erasure of such personal information. While you will usually not have to pay a fee to exercise these rights, in some cases, we may charge a reasonable fee if your request for access is clearly unfounded or excessive, or if you request multiple copies of the same information. Alternatively, we may refuse to comply with the request in such circumstances. We may need to request additional information from you to help us confirm your identity and ensure your right to access the information or to exercise any of your other rights.
We ensure that you can exercise your rights at any time, including updating your profile through the App at any time, opting out of personalized advertising or marketing, and deleting your account and/or your personal information stored by us through the “Delete Account” and “Delete my Data” functionalities within the App. Through your device settings, you can also opt in or opt out any push notifications, or, if applicable, geolocation services. Alternatively, you can also contact us at privacy@flapanthersgameday.com if you wish to exercise any of these rights, if you wish to designate an authorized agent to exercise any of these rights on your behalf, if you wish to request further information about any of the above rights, or if you are unhappy with how we have handled your personal information. We will respond to your inquiry within the timeframes required by applicable laws and regulations.
As permitted by law or to provide our services, we may retain and not immediately delete data we use to:
· Provide a good or service to you, or to complete a transaction requested by you or that you reasonably anticipate;
· Ensure the security and integrity of the App and our services;
· Debug to identify and repair errors that impair the existing or intended functionality of the App and our services;
· Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;
· Enable internal uses that are reasonably aligned with your expectations; and
· Comply with legal obligations.
Minors’ Privacy
We are committed to protecting the privacy and safety of young people using the Internet. We believe that children should get their parents’ or guardians’ consent before using the App and giving out any personal information. We do not knowingly collect personal information from children who are under the age of 18 without prior consent from such child’s parent or guardian.
If you have reason to believe that a child has provided personal information to us, please contact us at privacy@flapanthersgameday.com, and we will endeavor to delete that personal information from our databases unless the prior consent from such parent or guardian has been obtained.
Changes to this Policy and Contact Information
We may change this Policy from time to time to reflect changes on the App or in the law. We encourage you to review this Policy periodically to assure familiarity with the most current version. We will post all changes to the Policy here so that you will always know what information we gather, how we might use that information, and when we will disclose that information to third parties. You can tell that the Policy has been updated by checking the last revised date posted on the top of this page.
If any part of this Policy is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Policy shall continue in full force and effect.
